ORDERING

By agreeing to the terms of service you also agree to our Shipping Policy and Refund Policy for which explains all ordering information.

All products are made to order and have not been manufactured yet. Lead time will vary at the point of order, please contact sales@cudajet.com for the latest information.

Customer Verification & Order Acceptance

All orders placed through the CudaJet website are subject to review, verification, and formal acceptance by CudaJet Ltd.

Submission of payment does not constitute acceptance of the order. An order is only deemed accepted once it has been reviewed and explicitly confirmed by CudaJet Ltd.

CudaJet Ltd reserves the right, at its sole discretion, to conduct identity verification, fraud screening, and compliance checks (including but not limited to Know Your Customer (KYC) procedures) prior to accepting any order.

Customers may be required to provide supporting documentation, including but not limited to:

  • Government-issued identification
  • Proof of address
  • Confirmation of payment authorisation
  • Additional information deemed necessary to verify the legitimacy of the transaction

Customers must provide all requested information within 14 days of the request. Failure to do so, or the provision of information that cannot be satisfactorily verified, may result in the cancellation of the order.

CudaJet Ltd reserves the right to refuse or cancel any order where, in its sole judgement, a transaction presents a fraud, compliance, security, or reputational risk.

UNDERWATER JETPACKS

The buyer of the Underwater Jetpacks is responsible for knowing and understanding all safety information detailed in the product manual. By making this purchase you agree that you will read through the product manual thoroughly before use. You will contact sales@cudajet.com if you have any questions. Where the buyer is not the user, the buyer is responsible to ensure the user fully reads and understands the product manual before using the Underwater Jetpacks.

CudaJet accepts no responsibility for injury or death whilst using the Underwater Jetpacks.

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependants to use this site.

You must not transmit any worms or viruses or any code of a destructive nature.

A breach or violation of any of the Terms will result in an immediate termination of your Services.

We reserve the right to refuse service to anyone for any reason at any time.

You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy.

We have made every effort to display as accurately as possible the colours and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any colour will be accurate.

We reserve the right, but are not obligated, to limit the sales of our products or services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

This website www.cudajet.com is the only website where CudaJet products can be purchased. If purchasing from any other website, CudaJet is not responsible for the order nor the receipt of goods.  


SECTION 6 - ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.


You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

All orders are subject to verification, fraud screening, and formal acceptance by CudaJet Ltd. We reserve the right to request additional information to validate any transaction and to cancel any order that cannot be satisfactorily verified.

We may provide you with access to third-party tools over which we neither monitor nor have any control nor input.

Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).

We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website should be taken to indicate that all information in the Service or on any related website has been modified or updated.

 

Section 11A - Intellectual Property & Confidentiality

Ownership of Intellectual Property

All designs, schematics, internal components, and technical specifications of CudaJet products are the exclusive intellectual property and trade secrets of CudaJet Ltd. Purchasing a product does not grant any rights to reproduce, distribute, or disclose any proprietary aspects beyond intended use.

Restrictions on Photography and Sharing

Customers are strictly prohibited from photographing, recording, or sharing images, videos, or technical details of the internal components of any CudaJet product. This includes sharing publicly or privately, through social media, forums, emails, or direct communication with third parties.

Liquidated Damages for Unauthorized Disclosure

If a customer breaches this section, they agree to pay liquidated damages of £100,000 per violation. This amount reflects the significant commercial harm, loss of competitive advantage, and legal costs associated with unauthorized disclosure.

  • The £100,000 is payable immediately upon demand.
  • If actual damages exceed £100,000, CudaJet reserves the right to claim additional compensation.

Recovery of Profits & Trade Secret Theft

If the unauthorized disclosure results in financial gain for any third party, CudaJet is entitled to:

  • Recover all profits generated from the disclosure, including any sales, licensing, or indirect benefits.
  • Demand additional damages, including loss of market position and legal fees.
  • File a claim under UK trade secret laws, which may result in criminal prosecution and imprisonment for the violator.

Indemnification & Legal Fees

If legal action is required, the violating party agrees to reimburse CudaJet Ltd for all legal costs, court fees, investigation expenses, and damages incurred in enforcing this clause.

Injunction & Immediate Content Removal

CudaJet Ltd reserves the right to seek a court-issued injunction (legal order) requiring the removal of any leaked content and prohibiting further distribution.

  • You waive any right to contest such legal action and agree to comply immediately.

 

11B – Marketing, Promotion, and Public Exposure

This section applies regardless of whether the activity is commercial or non-commercial.

CudaJet Ltd retains exclusive rights over the commercial representation, branding, and public image of its products. By purchasing or using a CudaJet product, the purchaser and/or user agrees not to publicly share, display, or use the product in any promotional, marketing, commercial, or influencer-related content without prior written consent from CudaJet Ltd.

This includes, but is not limited to:

  • Social media posts, reels, or stories (e.g. Instagram, YouTube, TikTok, Facebook)

  • Promotional photoshoots or video content

  • Commercial brand partnerships or influencer campaigns

  • Press/media articles, interviews, or documentaries

  • Resale listings or third-party showcases

Compensation and Enforcement

Any unauthorised use for public exposure may result in:

  1. Immediate removal: CudaJet Ltd reserves the right to demand immediate takedown of the content across all platforms.

  2. Recovery of profits: If the unauthorised use has generated commercial benefit (including brand visibility, traffic, or revenue), CudaJet Ltd is entitled to recover all direct and indirect profits derived from the exposure.

  3. Brand damage: Where the unauthorised exposure has caused reputational harm or undermined commercial opportunities, CudaJet Ltd may pursue damages and legal costs.

  4. Liquidated damages: In cases of significant or wilful breach, a fixed liquidated damages amount of £50,000 per incident may be claimed, without prejudice to any higher actual damages.

These rights apply retroactively and remain enforceable even after the product has been delivered, resold, or transferred to a third party. CudaJet Ltd reserves the right to initiate legal proceedings to recover losses and enforce brand protections.

Approved Use and Brand Partnerships

CudaJet Ltd welcomes strategic partnerships and licensed collaborations that align with the brand’s values and image. To protect our official partners, all public exposure of the product must be approved in writing. This ensures that only authorised individuals or organisations may feature the product in a commercial or public setting.

Purchasers wishing to discuss licensing or media opportunities must contact sales@cudajet.com to obtain formal written permission. This helps safeguard the brand for everyone involved — including our most trusted collaborators.

11C – Commercial Use & Revenue-Generating Activities

CudaJet products are sold for private use only unless otherwise expressly agreed in writing by CudaJet Ltd.

The purchaser and/or user is strictly prohibited from using any CudaJet product for commercial, revenue-generating, or business purposes without prior written consent from CudaJet Ltd.

Prohibited commercial uses include, but are not limited to:

● Rental, leasing, or hire of the product
● Paid experiences, tours, or demonstrations
● Training, instruction, or coaching services
● Use within a business, hospitality, or tourism operation
● Any activity where the product is used directly or indirectly to generate income, financial benefit, or commercial advantage

Any public or private use of the product that results in financial gain, brand exposure, or commercial benefit shall be considered commercial use.

Where a purchaser or third party wishes to use the product for any such purposes, a separate commercial agreement, licence, or partnership arrangement must be entered into with CudaJet Ltd prior to such use.

Unauthorised Commercial Use & Financial Recovery

In the event of any unauthorised commercial or revenue-generating use of a CudaJet product:

● CudaJet Ltd shall be entitled to recover all revenues, profits, and financial benefits derived directly or indirectly from such use
● CudaJet Ltd reserves the right to claim additional damages, including loss of commercial opportunity, brand dilution, and reputational impact
● Where revenues cannot be accurately determined, CudaJet Ltd reserves the right to assess a reasonable commercial value based on the nature, scale, and duration of the unauthorised use
● CudaJet Ltd may require the user to enter into a retrospective commercial licence agreement on terms determined at its sole discretion

CudaJet Ltd may, at its sole discretion, elect to convert any unauthorised commercial use into a licensed use, subject to the payment of fees or royalties determined by CudaJet Ltd based on the scale and commercial value of the activity.

CudaJet Ltd reserves the right to obtain financial records, usage data, or other evidence necessary to assess the scale and value of unauthorised commercial activity.

11D – Incidental Capture & Third-Party Intellectual Property

CudaJet Ltd shall not be responsible for any third-party intellectual property, proprietary designs, trademarks, or other protected materials that may be incidentally captured, recorded, or displayed during the use of its products.

The purchaser and/or user acknowledges that use of the product in public or shared environments may result in the incidental capture of third-party assets, objects, or materials, whether intentionally or unintentionally.

CudaJet Ltd makes no representation or warranty that such incidental capture does not infringe the rights of any third party. Responsibility for ensuring compliance with applicable intellectual property laws and regulations rests solely with the purchaser and/or user.

Indemnification for Third-Party Claims

The purchaser and/or user agrees to indemnify, defend, and hold harmless CudaJet Ltd, its directors, officers, employees, and affiliates from and against any and all claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in connection with:

● The use of the product in any environment where third-party intellectual property may be present
● The capture, recording, distribution, or publication of any content involving the product
● Any alleged or actual infringement of third-party intellectual property rights resulting from such use

This indemnification obligation shall survive the termination of the agreement and the sale, transfer, or use of the product.

11E – Content Creation & Third-Party Rights

CudaJet Ltd may from time to time produce, publish, or distribute visual, photographic, or video content featuring its products.

While reasonable care is taken during the creation of such content, CudaJet Ltd does not guarantee that all environments, locations, or elements captured are free from third-party intellectual property, proprietary designs, or protected materials.

CudaJet Ltd shall not be liable for any incidental or unintended inclusion of third-party intellectual property within such content, to the maximum extent permitted by applicable law.

SECTION 12 - PROHIBITED USES

In addition to other prohibitions as set forth in the Terms of Service, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet. We reserve the right to terminate your use of the Service or any related website for violating any of the prohibited uses.


SECTION 13 - DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free.

We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable.

You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.

You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

In no case shall CudaJet, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

Although diligence has been taken to ensure the accuracy of the information on this site, CudaJet assumes no responsibility therefore. The materials may contain inaccuracies and errors. CudaJet does not warrant the accuracy or completeness of the materials. You acknowledge that any reliance on any information shall be at your sole risk and CudaJet does not assume any responsibility for any inaccuracies or errors. CudaJet reserves the right to modify data and technical specifications without further notice.

In the event of a Worldwide catastrophe or any event causing the business to deviate from the normal course of action, such as but not limited to; global pandemics, supply chain breakdown, economic failure and war. CudaJet may extend its estimated delivery until a more suitable time. CudaJet may also delay any approval of refunds. In such an event we will give you constant updates. Limitation of Liability for Content

To the fullest extent permitted by law, CudaJet Ltd disclaims any liability arising from:

● The incidental capture of third-party intellectual property in any media produced
● Any claims relating to background objects, environments, or elements not owned or controlled by CudaJet Ltd
● Any alleged infringement arising from the use or publication of such content

SECTION 14 - INDEMNIFICATION

You agree to indemnify, defend and hold harmless CudaJet and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference or your violation of any law or the rights of a third party.


SECTION 15 - SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.


SECTION 16 - TERMINATION

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

This agreement supersedes any prior or contemporaneous agreements, communications, or proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

Both parties acknowledge that these Terms and Conditions are the result of arm's length negotiations, and no presumption or burden of proof shall arise favoring or disfavoring any party by virtue of the authorship of any provisions of these Terms.

If any provision of these Terms and Conditions is held to be invalid, illegal, or unenforceable by any court or competent authority, such provision shall be deemed severed from these Terms, and the remaining provisions shall remain in full force and effect. If any invalid or unenforceable provision could be made valid or enforceable by modification, such provision shall apply with the modifications necessary to make it valid and enforceable, consistent with the original intent of the parties as closely as possible.

Shipping Policy and Payments

  • All prices are displayed without any taxes or local fees. All taxes and local fees are payable by the customer. 
  • The customer is responsible to know and understand local shipping and import laws. 

  • The customer may be asked to provide a photographic ID at the point of delivery.

Underwater Jetpack Orders

All Underwater Jetpacks are manufactured on a made-to-order basis. The production of any order shall only commence upon receipt of full payment.

Orders will generally be processed in the sequence in which they are received. Notwithstanding the foregoing, CudaJet reserves the right, in its sole discretion, to prioritize and ship higher-priority items ahead of other orders, which may affect the processing and shipping times of your order.

CudaJet is under no obligation to disclose the position of any order within the production queue. The position of your order in the queue is subject to change, including but not limited to being reprioritized by higher-priority orders.

CudaJet will make reasonable efforts to provide an accurate estimated time of delivery; however, such estimates are non-binding and subject to modification.

Please be advised that the ‘Founders Edition’ is a limited, one-time offer, with only 20 units available. Once all units are sold, no further orders for the ‘Founders Edition’ will be accepted.

Storage and Charging Requirements:

  • All Underwater Jetpacks are shipped with a partial charge to ensure safe transit and storage. Upon receipt of the jetpack, customers are required to return to storage charge. The unit must be fully charged before its first use. This ensures optimal performance and longevity of the battery.
  • Failure to adhere to these charging requirements may result in reduced battery life or performance issues, for which the customer will be responsible.

Warranty Activation

To activate the warranty for your Underwater Jetpack, the signed warranty form must be completed and returned within 14 days of receipt of the product.

Important: Use of the product before the signed warranty form has been submitted and approved will void all warranty coverage. The Underwater Jetpack must not be used until the user has:

  1. Completed and returned the signed warranty form, and
  2. Read and understood the full user manual.

Failure to meet these requirements may result in damage that is not covered under warranty. Misuse or operation outside the guidelines provided in the manual will also invalidate the warranty.

Full Payment

Full payment must be made before an order can be considered for acceptance.

Receipt of payment does not constitute acceptance of the order. All orders remain subject to verification and formal acceptance by CudaJet Ltd as outlined in the Customer Verification & Order Acceptance section.

Production will not commence until:

  1. Payment has been received in full, and
  2. The order has been formally accepted by CudaJet Ltd

CudaJet Ltd reserves the right to hold funds during the verification and review process.

All duties, taxes, and any additional charges are the sole responsibility of the customer and will not be included in the full payment unless explicitly stated in writing by CudaJet Ltd. Customers are responsible for ensuring that any applicable import duties, taxes, or fees are paid as required by their local authorities.

Orders will be shipped only after full payment has been received. If any products are shipped without full payment, legal ownership of the goods shall remain with CudaJet Ltd until the outstanding balance is settled in full. CudaJet Ltd reserves the right to reclaim or take legal action to recover any unpaid goods.

Shipping Cost

Where shipping costs exceed the allocated flat fee, CudaJet retains the right to invoice and receive payment of the balance before the release of goods.


Delivery Schedule

CudaJet aims to ship your products within 180 days from order placement or by the estimated date given in your order confirmation, whichever comes after. We will do our best to ship the products to you within the estimated time frame or date stated in the order confirmation, we will provide you with updates on the delivery of your process as we see fit. However, you agree and understand that delays are possible and as a result, the product(s) may be delivered to you after the estimated date. CudaJet is not responsible for any damages, costs or loss of income caused by delays and is not obligated to provide a discount, refund or any credit due to delays. 

A failed collection from the customer may result in additional shipping fees payable by the customer. No refund will be given for a failed collection.

No refund will be given for a lost order due to incorrect shipping details or a failed collection. 

Where a partial payment has been made, the full balance will be requested 45 days in advance to shipping the goods. If you are unable to pay the full balance on request, or do not pay the full balance in time, you may lose your place in the order queue, delaying the shipment of your products.

If the full payment has not been made once the goods are cleared to ship, CudaJet reserves the right to charge 1% of the total cost of the order per week the goods are held. This is to help cover the cost of storage and proper maintenance on the products. If after 30 days the goods are still not paid for, CudaJet has the right to sell these goods on. No refund will be given for any initial deposit. 



Right Of Refusal 

CudaJet has the right to refuse or cancel any order without reason, in this case, you will be refunded the full amount paid.

Cancellation Policy

CudaJet Ltd takes all cancellation requests seriously. Due to the made-to-order nature of our products, all sales are considered final upon receipt of payment. Each order is produced to precise specifications, requiring immediate allocation of resources, scheduling of production, and procurement of materials. As such, cancellations and refunds are not permitted once payment has been made.

No Right to Cancel After Payment

Once an order has been formally accepted by CudaJet Ltd and production has commenced, the order is non-refundable and non-cancellable. Customers must ensure they are fully committed before proceeding with payment.

Exceptional Circumstances

In rare and exceptional cases, CudaJet Ltd may, at its sole discretion, consider a cancellation request. If a cancellation is granted, refunds will be subject to the following conditions:

  • A non-refundable deposit of 50% of the total order value, deducted from the refund amount. This reflects the costs associated with custom production, materials, and resource allocation.
  • Any transaction fees incurred during the payment process will not be refunded.
  • Refunds may take up to 120 working days to process due to administrative and financial procedures.

CudaJet Ltd reserves the right to determine whether a cancellation request qualifies as an exceptional case, and approval is not guaranteed.

Expedited Orders

Orders requiring expedited fulfillment involve immediate investment in production and logistics. Due to the urgency of these orders, they cannot be cancelled or refunded once placed. The rapid allocation of resources makes refunds infeasible.

 

Verification Failure & Administrative Fees

In the event that an order is cancelled due to:

  • Failure to provide requested verification information within the required timeframe, or
  • Failure to respond to verification requests within the required timeframe, or
  • Inability to satisfactorily verify the customer or transaction at CudaJet Ltd’s sole discretion, or
  • Determination of fraud, compliance, or security risk

CudaJet Ltd reserves the right to retain a reasonable administrative and processing fee of up to 10% of the total order value.

This fee reflects costs incurred, including but not limited to:

  • Payment processing and transaction fees
  • Currency conversion and financial losses
  • Fraud prevention, compliance checks, and verification procedures
  • Administrative handling and order processing

The remaining balance will be refunded to the original payment method.

Chargeback Policy

Communication Requirement: Before initiating a chargeback, customers are required to make a good-faith effort to resolve any issues directly with CudaJet by contacting our customer service team. Failure to do so before initiating a second chargeback may result in penalties as outlined below.

Good Faith Effort: We are committed to fair and transparent resolution of issues. Customers are strongly encouraged to resolve disputes directly with CudaJet before initiating a chargeback to avoid unnecessary penalties.

Chargeback Procedure: If a chargeback is initiated while your order is still within the production lead time, all production activities will be suspended immediately. The duration during which the chargeback is active will not count toward the production lead time. Your order will be stored in its current state until the chargeback dispute is resolved.

Settlement of Chargeback: To resolve the chargeback, CudaJet may offer either to complete the order or to provide a partial refund of 50% of the total order value, minus any applicable transaction fees, as outlined in our Cancellation Policy.

Resolution Notification: If CudaJet prevails in the chargeback dispute, you will be contacted within 14 days of the resolution. CudaJet reserves the right, at its sole discretion, to either resume production of your order or issue a partial refund.

Inquiry After Chargeback: If you open an inquiry disputing the charge after a chargeback has been resolved in CudaJet's favor, and your order is still in production:

  • Order Cancellation: Your order will be cancelled.
  • Partial Refund: You will be entitled to a partial refund of 50% of the total order value, minus any applicable transaction fees.
  • Requirement for Refund: To process the partial refund, you must first remove the inquiry. The partial refund will be issued within 14 days of confirmation that the inquiry has been removed.

Penalties for Repeated Chargebacks: Customers who initiate a second or subsequent chargeback after a previous chargeback has been resolved may face the following consequences:

    • Order Cancellation: Your order will be canceled, and you will receive a partial refund of 50% of the total order value, minus any applicable fees.
    • Refund Processing: The partial refund will be processed within 14 days of the resolution of the second chargeback. The refund amount will be 50% of the total order value, minus any transaction fees and costs associated with the chargeback.
    • Account Termination: CudaJet may terminate your account and refuse future transactions.
    • Blacklisting: You may be added to a blacklist shared among businesses to prevent further transactions.
    • Legal Action: CudaJet reserves the right to pursue legal action to recover losses and associated costs.
    • Additional Fees: You may be liable for additional fees related to the chargeback, including investigation and transaction fees.

Final Resolution: After the partial refund has been issued and the inquiry has been removed, no further actions or refunds will be considered. This resolution is final and conclusive. CudaJet reserves the right to declare the matter resolved at any time once these conditions are met.



Buyer Information

The buyer is responsible for entering the correct and in date information and must check this is correct before completing payment. CudaJet holds no responsibility for information entered incorrectly. 


Change of Buyer Information

The shipping address can be changed at any time before shipment by emailing sales@cudajet.com

If the shipping address is within a more expensive shipping zone the balance will be payable before the goods are released. If the new shipping address falls under a cheaper shipping zone then we will refund you the balance within 14 days of the release of goods. Please note all duties and taxes are payable by the customer. 

The order can be changed to another person upon written request sent to sales@cudajet.com and acceptance from CudaJet. We reserve the right to refuse a change in buyer information.

You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.

You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

In no case shall CudaJet, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

Design changes and improvements may mean that parts or your product specification are different to that shown on the website and may vary from product to product. Colour errors on the website should be expected and actual colours may vary. This is due to many reasons such as a variance in; how people see colour, lighting, computer monitor displays, and manufacturing batches. Therefore CudaJet cannot guarantee the colours of our products accurately portray the true colour of the product and may vary from product to product.
